These Terms & Conditions ("Terms") govern your access to and use of Arguz (the "Service"), operated by Arguz SpA, Chile ("Arguz", "we", "us", or "our"). By accessing or using the Service, you agree to these Terms.
1. Service Description
The Service is a software-as-a-service platform for Kubernetes observability and incident correlation. It provides continuous monitoring, event correlation, and incident narratives for connected clusters.
2. Eligibility and Accounts
You must be at least 18 years old and have authority to bind your organization. You agree to provide accurate information and keep your account details up to date. You are responsible for all activity under your account and for maintaining the security of your credentials.
3. Acceptable Use
You will not misuse the Service, interfere with its operation, attempt to gain unauthorized access, or use the Service for illegal, harmful, or infringing activities. You must comply with all applicable laws and regulations.
4. Subscriptions, Fees, and Taxes
Paid plans are billed in advance on a recurring basis as described at checkout or in your account. Prices exclude applicable taxes unless stated otherwise. If a payment is overdue, we may suspend or downgrade your access until payment is received.
5. Free Trials and Evaluations
If we offer a free trial, the terms of the trial (duration and limitations) will be disclosed at sign-up. Unless you cancel before the trial ends, your subscription may automatically convert to a paid plan.
6. Data, Privacy, and Security
We process personal data as described in our Privacy Policy. You are responsible for your use of the Service and for ensuring that you have the right to provide any data that you submit or connect to the Service.
7. Intellectual Property
The Service, including all software, content, and trademarks, is owned by Arguz or its licensors. We grant you a limited, non-exclusive, non-transferable right to use the Service during the term of your subscription. You retain ownership of your data.
8. Third-Party Services
The Service may integrate with third-party services. We are not responsible for third-party products or their terms, and your use of those services is governed by their respective agreements.
9. Termination
You may cancel at any time through your account. We may suspend or terminate access if you breach these Terms or if required by law. Upon termination, your right to use the Service ends and any outstanding fees remain due.
10. Disclaimers
The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
11. Limitation of Liability
To the maximum extent permitted by law, Arguz will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenues, data, or goodwill, arising from or related to your use of the Service.
12. Governing Law
These Terms are governed by the laws of the Republic of Chile. Any disputes will be subject to the jurisdiction of the competent courts of Santiago de Chile, unless mandatory law provides otherwise.
13. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will provide notice by posting the updated Terms on this page. Your continued use of the Service constitutes acceptance of the updated Terms.
